These Terms of Service ("Terms") govern your access to and use of Field Surveillance Log (the "Service"), a web-based logging application provided by Tharsis Investigations LLC ("Tharsis," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Field Surveillance Log is a tool that allows users to create timestamped, GPS-tagged log entries with associated notes, organize entries by case name or file number, and export logs for use in their own case documentation. The Service is provided as a working tool for licensed investigators and related professionals; it is not a substitute for professional judgment, agency policy, or legal advice.
You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at kevin.kubitskey@gmail.com if you suspect unauthorized use of your account.
The Service is offered on a subscription basis at the following rates:
Subscriptions are processed through Stripe, a third-party payment processor. By subscribing, you authorize recurring charges to your chosen payment method until you cancel. Subscriptions renew automatically at the end of each billing period unless canceled prior to the renewal date. To cancel, contact kevin.kubitskey@gmail.com; cancellation takes effect at the end of the then-current billing period. Fees already paid are non-refundable except where required by law.
You agree to use the Service only for lawful purposes connected to your professional investigative, legal, or related work. You agree not to:
You are solely responsible for ensuring your use of the Service, including any surveillance activity you log, complies with all applicable federal, state, and local law and any licensing requirements that apply to you.
The Service timestamps and geotags entries using your device's system clock and location services. Accuracy depends on your device, its settings, and prevailing signal conditions, and is not guaranteed. Tharsis makes no representation that logs generated by the Service will be admissible in any court, hearing, or proceeding. You are responsible for independently verifying the accuracy of any entry and for complying with your jurisdiction's rules of evidence and professional standards before relying on exported logs in any legal or investigative work product.
The Service, including its software, design, and content (excluding your own log entries and data), is the property of Tharsis Investigations LLC and is protected by applicable intellectual property laws. You retain ownership of the data and entries you create using the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA LOSS WILL NOT OCCUR.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THARSIS INVESTIGATIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service and cancel your subscription at any time. Upon termination, your right to access the Service ends; provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 8, 9, and 12.
We may update these Terms from time to time. Material changes will be communicated by posting an updated version with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Pima County, Arizona.
